Why Do I Need a Power of Attorney?

A power of attorney (POA) is a legal document appointing someone other than yourself to handle financial and legal matters on your behalf. With a power of attorney, the person you appoint will be legally authorized to handle important matters for you, including paying your bills and managing your finances and investments, if you are unable to do so for yourself.  The benefits include the following:

  • Permits You To Avoid the Courts and Attorneys Fees.

What are the Different Types, and When Do You Use Each Type?

POA's are used to many different purposes (i.e. to faciliate financial and health decisions).   There are two basic types of POA’s:

  • nondurable; and

  • durable

 

The difference between durable and non durable is that durable POA's continue in effect when the principal becomes incapacitate; whereas, non durable POA's automatically end upon mental incapacity of the principal.
